LANSING, NY (607NewsNow) – A lawsuit is moving forward in Lansing.

A Tompkins County Supreme Court Judge has affirmed the right to challenge the Lansing Zoning Board of Appeals’ (ZBA) classification of a proposed data center as a permissible land use near the lakeshore and adjacent wildlife preserve.

FLX Strong and Cayuga Lake Environmental Action Now (CLEAN) filed the suit against the Lansing ZBA, TeraWulf, and its subsidiaries in January. The groups filed a motion to dismiss the case shortly afterward.

The ZBA and TeraWulf are expected to respond to the court ruling this month.
