WAVERLY, N.Y. (WHCU) – A Tioga County man is in custody after his 8-month-old child overdosed.

According to the Waverly Police Department, 48-year-old Timothy Henry was found and arrested on Tuesday in Sayre, Pennsylvania. A warrant for his arrest was issued about two months ago.

On the morning of October 13, authorities were called to a residence on Broad Street in the Village of Waverly for a report of a child in ‘severe respiratory distress.’ When they arrived, they found the infant girl was not breathing and rendered medical care. The girl was transported to the Robert Packer Emergency Room where she received further life-saving measures. The infant was then flown to Geisinger Medical Center in Danville, Pennsylvania for further care, where she was found to have fentanyl in her system. She has since made a full recovery.

Henry is charged with felony assault, felony reckless endangerment, misdemeanor reckless endangerment, and misdemeanor endangering the welfare of a child. Henry is in Bradford County Jail on $100,000 cash bail while he awaits an extradition hearing.
