ALBANY, N.Y. (WHCU) – The New York State Department of Labor officially finalizes farm worker overtime regulations.

Starting January 1st, 2024, the threshold to pay overtime will reset to 56 hours. The threshold will decrease by 4 hours every other year, eventually reaching 40 hours in the year 2032.

Proponents of Commissioner Roberta Reardon’s order, based on recommendations by the Farm Laborer’s Wage Board, to reduce the overtime pay threshold say it will ensure equity for farm workers. Critics say it will force workers out of state for more hours, and strain farmer finances.

The Governor and New York State Legislature recently enacted new tax credits they say will help farms transition easier.

  • Investment Tax Credit increased from 4% to 20% for farm businesses, encouraging potential automation of farm production
  • Farm Worker Retention Tax Credit increased to $1,200 per employee to provide near-term financial relief to farmers
  • Refundable tax credit established for overtime hours paid by farm employers at the level established by the new regulation up to 60 hours
