SYRACUSE, NY (607NewsNow) – A retired member of the Tioga County Sheriff’s Office has won a lawsuit.
On June 26, former Undersheriff Wayne Moulton was awarded $2 million in damages, according to WENY-TV.
In 2022, Moulton sued Tioga County, the Sheriff’s Office, Sheriff Gary Howard, and Sheriff’s Captain of Operations Shawn Nalepa in U.S. District Court for violating his 1st and 14th amendment rights.
In the lawsuit, Moulton claims he was accused of drinking on the job, which he denies, and forced to retire or be fired without due process. This happened while Moulton was openly discussing a potential campaign for Sheriff.
He further alleges that false, defamatory statements were made to remove him from a list of retired law enforcement that would have allowed him to carry a concealed firearm and effectively ended his career in law enforcement.
A jury ultimately sided with Moulton, who receives $1.5 million for economic damages and $500,000 for non-economic damages.
The jury also reportedly found Tioga County liable for punitive damages, though a dollar amount has not yet been reached.
